It shall be unlawful for any person to do any act which is forbidden or declared to be unlawful, or to fail to do or perform any act required in Section 13-81 of this Code. Any person convicted of a violation of this Section shall be guilty of a noncriminal violation and may be fined by an amount not to exceed five hundred dollars ($500.00). Where any violation is a continuing offense, each day that the violation continues shall be considered and held to be a separate and distinct offense. In addition to noncriminal penalties that may be imposed by the Municipal Court, the following civil surcharges may be imposed administratively for the violation of the mandatory restrictions of Section 13-81 of this Code. Surcharges shall be imposed by the Town as a one (1) time charge on the customer’s monthly water user fee for the month in which the noncompliance occurred. Multiple surcharges may be imposed during any single month for multiple violations. The following surcharges may be imposed:

(1) First offense: a written warning.

(2) Second offense in a calendar year: a two hundred fifty dollar ($250.00) surcharge.

(3) Third and subsequent offenses in a calendar year: a five hundred dollar ($500.00) surcharge.

(4) Fourth and subsequent offenses in a calendar year: a five hundred dollar ($500.00) surcharge and the installation of a flow restrictor on the customer’s meter. (Ord. 1312 §1, 2019)
