(a) As used in this Section, the following definition shall apply:

Golf car means a self-propelled vehicle not designed primarily for operation on roadways and that has:

(a) A design speed of less than twenty (20) miles per hour;

(b) At least three (3) wheels in contact with the ground;

(c) An empty weight of not more than one thousand three hundred (1,300) pounds; and

(d) A carrying capacity of not more than four (4) persons.

(b) No golf car may be operated on any street, road or right-of-way within the Town unless community covenants, conditions and restrictions have been formally adopted within the discrete community where such vehicle is operated and approved by the Town, establishing standards for the operation of golf cars on the streets, roads and rights-of-way‘ and any golf car is being operated in compliance with those standards.

(c) No community covenants, conditions and restrictions which establish standards for the operation of golf cars on streets, roads and rights-of-way shall take effect until signs conforming to national highway safety standards are posted in the affected area(s) providing notice of the use of golf cars within the community. Sign content and placement shall be at the direction of Town staff.

(d) No community covenant, condition or restriction shall authorize the operation of a golf car by a person without a valid driver’s license. No community covenant, condition or restriction shall authorize the operation of a golf car on a state or county highway.

(e) All community covenants, conditions and restrictions which establish standards for the operation of golf cars on streets, roads and rights-of-way shall comply with Section 201 of the Model Traffic Code, "Obstruction of view or driving mechanism – hazardous situation," and shall comply with Section 234 of the Model Traffic Code, "Slow-moving vehicles – display of emblem."

(f) The recognition of community covenants, conditions and restrictions which establish standards for the operation of golf cars is not a delegation of authority by the Town to private parties, nor will this Section be interpreted to interfere with or impair the Town’s ability to enforce any provision of the Town’s Codes, including the adopted Model Traffic Code, 2010 edition, according to the enforcement and remedy provisions contained therein.

(g) Violation of this Section is deemed to be a noncriminal violation, subject to the penalties established in Section 1-72 of this Code. (Ord. 1059 §1, 2011)
