(a) No owner, lessee, agent, occupant or person/entity in possession or control of any occupied or unoccupied lot, tract of land or any part thereof in the Town shall permit or maintain on any such lot or tract of land or along the sidewalk, street or alley adjacent thereto any growth of weeds to a height greater than eight (8) inches.

(b) No owner, lessee, agent, occupant or person/entity in possession or control of any occupied or unoccupied lot or tract of land or any part thereof in the Town shall permit or maintain on any such lot, tract of land or along the sidewalk, street or alley adjacent thereto any growth of brush.

(c) In agricultural districts, weeds (other than noxious weeds governed by Section 7-39 of this Code) shall be maintained to not exceed a height of eight (8) inches across all portions of any property that adjoins a residential or nonresidential district boundary, or along any public right-of-way.

(d) In order to retain certain properties in their historic or natural states, the following areas shall be exempt from the requirements of Subsection (a) above:

(1) Agricultural fields where a current crop is being grown (not to include fields in fallow rotation);

(2) Town-owned open space;

(3) Stream and lake beds or banks; and

(4) Designated and delineated wetlands. (Ord. 809 §2, 2005, Ord. 998 §2, 2005)
