(a) As used in this Section, the following definitions shall apply:

Animal shall include dogs, cats and any other animal designated by the Town Manager, or designee.

Town-sanctioned event shall include any event sponsored by the Town and any event sponsored in part by the Town, as designated by the Town Manager.

(b) No owner or keeper of an animal present at a Town-sanctioned event shall fail to comply with the provisions of Article V of this Chapter, including but not limited to Sections 7-113, 7-116, 7-122 and 7-123.

(c) It shall be unlawful for any owner or keeper of an animal present at a Town-sanctioned event to fail to immediately remove the animal from the area of the Town-sanctioned event at the request of a Town representative, Town police officer or community service officer.

(d) No owner or keeper of an animal shall allow or permit said animal to be present at the Frederick Farmer’s Market. The area of the Farmer’s Market subject to this restriction includes any area where vendors are located, including a distance of twenty (20) feet from the location of the vendors, but does not include Crist Park. Neither physical confinement nor having the animal on a leash is a defense to prosecution under this Section, unless the animal is fully contained in a vehicle.

(e) Exceptions. This Section does not apply to police service dogs or personal service dogs. Additional exceptions may be granted at the sole discretion of the Town Manager, or designee. Such exception shall be in writing.

(f) Violation of this Section is deemed to be a noncriminal violation, subject to the penalties established in Section 1-72 of this Code, as amended. (Ord. 1082 §1, 2012; Ord. 1088 §1, 2012)
