(a) No person shall keep or harbor within the Town limits any animal that may reasonably and generally be categorized as fowl, livestock or wild animal, except as herein provided, and except rodents, cats and birds commonly kept within the home.

(b) It shall be unlawful for any person or entity who is an owner, lessee, agent or occupant in possession or control of any lot, tract of land or any part thereof in close proximity or adjacent to any developed property in the Town to fail to prevent rodent pests residing upon such lot or tract of land from relocating to, infesting or otherwise damaging the real property of another, including any public land, sidewalk, street or alley.

(c) The condition of any rodent pests described in Subsection (b) above shall be deemed a public nuisance, whether such rodent pests are originating or arriving on any such lot or tract, and shall be subject to abatement pursuant to this Chapter and the penalty provisions set forth in Section 1-72 and Section 10-9 of this Code. It shall be the responsibility of the owner of property in close proximity or adjacent to any developed property within the Town to provide for the removal or extermination of any and all such rodent pests in conformance with the provisions of this Code and the laws and regulations of the State.

(d) As used in this Section, the term rodent pest shall include any prairie dog, ground squirrel, pocket gopher, jackrabbit or other rodent not commonly kept within the home.

(e) As used in this Section, the term in close proximity to any developed property shall include any lot or tract within one hundred (100) feet of a platted or improved land parcel. (Ord. 1070 §2, 2012)
