(a) In addition to any high use water charges that may be imposed pursuant to the then adopted water rate schedule of the Town, if the annual usage for any water tap within the Town exceeds the water allotment as determined in this Division, the Town will notify the user of the actual additional CBT units or native water shares that the user will be required to transfer and/or dedicate to the Town.

(b) The Town may notify users if their rate of usage is projected to be greater than their annual allotment based on actual usage when compared with the remaining time left in the calendar year.

(c) Upon notice from the Town of a continued overage of water usage, the user or property owner is required to transfer and/or dedicate to the Town the additional water units or shares or, at the Town’s discretion, a payment in lieu thereof within forty-five (45) days of notice by the Town. The Town shall then have the additional water dedication for the property served accounted for in the allotment of water usage allowed for the property. Failure by a user or property owner to satisfy the additional water units, shares requirement, or payment in-lieu within the allotted time shall be cause for termination or suspension of water service by the Town until the requirement is satisfied.
