Sec. 10-115. Drug free zones.
(a) As used in this Section, the following definitions shall apply:
Drug free zone shall mean:
(a) All areas of any public or private elementary, middle, secondary or vocational school, or any public park.
(b) Any street, alley, sidewalk, playground or other area accessible to the public which is within one thousand (1,000) feet of such school or public park and which is accessible to the public. Measurement shall be made from the property line of any school or public park.
(c) Any school bus, as defined by state law, engaged in the transportation of persons who are students at any public or private elementary, middle or secondary school.
Marijuana is defined in Section 10-111 of this Article.
(b) It shall be unlawful for any person to possess up to six (6) ounces of marijuana within a drug free zone. This Section is designated a criminal violation, subject to the penalties set forth in Subsection 1-72(b) of this Code. (Ord. 1087 §1, 2012)
